3. Products and Pricing
3.1 Product Descriptions and Accuracy
HELVOR LLC strives to display the colors, sizes, fabrics, and details of our women’s athletic apparel (Golf, Running, Tennis & Pickleball, Training, Yoga & Pilates) as accurately as possible. However, we cannot guarantee that your computer monitor’s display of any color will be accurate. All measurements, weights, and specifications provided on product pages are approximate and for reference only. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted your order).
3.2 Pricing and Taxes
All prices displayed on helvor.space are in United States Dollars (USD) unless otherwise indicated. Prices are subject to change without notice. Despite our best efforts, a small number of products may be mispriced. If we discover a pricing error, we will, at our discretion: (i) contact you for instructions before shipping; (ii) cancel the order and refund the amount paid; or (iii) honor the incorrect price if the error was clearly in your favor and not a manifest error.
Taxes are calculated based on the shipping address and applicable state and local laws within the United States. For international orders, you are responsible for any customs duties, import taxes, or value-added taxes (VAT) imposed by your country. HELVOR is not responsible for delays caused by customs or for any fees levied by your local government.
3.3 Limited Quantities and Availability
All products are offered subject to availability. We reserve the right to discontinue any product at any time. In the event that a product is out of stock after you place an order, we will notify you and offer you the option to wait for restocking, substitute a similar product, or receive a full refund.
3.4 Promotions and Discount Codes
From time to time, HELVOR may offer promotional codes, coupons, or discounts. Such promotions are non-transferable, cannot be combined with other offers unless explicitly stated, and have no cash value. Promotional codes must be entered at checkout before an order is completed. We reserve the right to cancel any order or discount if we suspect fraud, error, or abuse.
4. Order Placement, Acceptance, and Cancellation
4.1 Order Confirmation
After you place an order on helvor.space, you will receive an automated email acknowledging receipt of your order. This email is not an acceptance of your order; it is a confirmation that we have received it. We reserve the right to accept or decline your order for any reason, including but not limited to product unavailability, payment verification issues, suspected fraud, or shipping address problems.
4.2 Order Acceptance
A legally binding contract between you and HELVOR LLC is formed only when we send you a shipment confirmation email that includes tracking information. Until that email is sent, we may cancel your order and refund your payment without penalty.
4.3 Order Cancellation by HELVOR
We may cancel any order at any time before shipment. Reasons include but are not limited to: suspicion of fraudulent activity, violation of these Terms, inability to verify billing information, or force majeure. If we cancel your order after you have paid, we will issue a full refund to your original payment method via Stripe within 5-10 business days.
4.4 Customer Order Modifications and Cancellations
As stated in our Refund and Return Policy, you may request cancellation or modification of an order within 2 hours of placement by contacting hello@helvorshop.com or calling +84857491111. After that window, the order may have been processed and cannot be changed; you will need to follow the standard return process after receiving the item.
5. Payment Terms
5.1 Accepted Payment Methods
All payments are processed through Stripe. We accept the following forms of payment: Visa, Mastercard, American Express, Discover (credit and debit cards), Apple Pay, and Google Pay. We do not accept PayPal, Venmo, cryptocurrency, wire transfers, cash on delivery, checks, or money orders.
5.2 Authorization and Billing
By providing a payment method, you represent and warrant that you are authorized to use that payment method. You authorize HELVOR and Stripe to charge the total amount of your order (including taxes and shipping) to the payment method provided. If your payment is declined, you agree to provide an alternative valid payment method within 24 hours, or we may cancel your order.
5.3 Billing Information
You agree to provide current, complete, and accurate billing and shipping information. We reserve the right to verify your billing address with your credit card issuer. If the billing address you provide does not match the address on file with your bank, we may cancel your order.
5.4 Stripe Terms
Your use of Stripe’s payment processing is subject to Stripe’s own terms of service and privacy policy. HELVOR is not responsible for any issues arising from Stripe’s platform, including but not limited to temporary outages or processing delays.
6. Shipping, Delivery, and Title
6.1 Shipping Policy
Shipping timelines, methods, and costs are detailed in our Shipping Policy, which is incorporated into these Terms. Generally, we ship to all 50 US states and internationally. Estimated delivery times are provided as a courtesy and are not guaranteed. HELVOR is not liable for delays caused by carriers, customs, weather, or other factors beyond our reasonable control.
6.2 Transfer of Title and Risk of Loss
Title to products and risk of loss pass from HELVOR to you upon delivery of the products to the common carrier (e.g., USPS, UPS, FedEx, DHL) at our shipping facility. This means that once the carrier takes possession of your package, any loss, damage, or delay is the responsibility of the carrier, not HELVOR. However, we will assist you in filing claims with the carrier for lost or damaged packages. For US shipments, we recommend purchasing shipping insurance for high-value orders.
6.3 International Shipping and Customs
For international orders, you are the importer of record. You are responsible for complying with all laws and regulations of the destination country. We will not undervalue products or mark them as “gifts” to avoid customs duties. Doing so is illegal and violates these Terms. Any customs fees, brokerage fees, or import taxes are your sole responsibility. If you refuse to pay such fees and the package is returned to HELVOR, your refund will be reduced by the original outbound shipping cost and any return shipping fees incurred.
7. Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed exclusively by our Refund and Return Policy, which is a part of these Terms. By placing an order, you acknowledge that you have read and agree to that policy. Key provisions include a 30-day return window, unworn/unwashed condition requirement, and non-returnable categories (e.g., underwear, final sale items). Refunds are processed through Stripe to the original payment method within 5-7 business days of receipt of return.
8. Intellectual Property Rights
8.1 Ownership
All content on the helvor.space website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of HELVOR LLC or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The HELVOR name, logo, and all related product names, design marks, and slogans are trademarks or registered trademarks of HELVOR LLC. You may not use such marks without our prior written permission. All other trademarks not owned by HELVOR that appear on the site are the property of their respective owners.

HELVOR grants you a limited, non-exclusive, non-transferable, revocable license to access and make personal, non-commercial use of the website and its content. HELVOR DOES NOT WARRANT THAT:

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU. IN SUCH CASES, WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT REQUIRED BY LAW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HELVOR LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO (I) YOUR USE OR INABILITY TO USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY PRODUCTS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF HELVOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU PAID TO HELVOR IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100.00 (ONE HUNDRED US DOLLARS), WHICHEVER IS GREATER.
BECAUSE SOME STATES OR COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, HELVOR’S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless HELVOR LLC, its members, managers, officers, employees, agents, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorneys’ fees) arising from:
(i) Your use of and access to the Service;
(ii) Your violation of any term of these Terms;
(iii) Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
(iv) Any claim that your content or conduct caused damage to a third party.
This indemnification obligation will survive the termination of these Terms and your use of the Service. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate fully with us in asserting any available defenses.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded from application.
13.2 Dispute Resolution – Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES YOU TO ARBITRATE DISPUTES WITH HELVOR ON AN INDIVIDUAL BASIS, RATHER THAN PURSUING CLASS ACTIONS OR JURY TRIALS IN COURT.

If we cannot resolve a dispute informally, you and HELVOR agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any products sold (including with respect to the validity, enforceability, or scope of this arbitration provision) shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.
The arbitration shall be held in Sheridan, Wyoming, or at another mutually agreeable location. The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction. You and HELVOR agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and HELVOR each waive any right to a jury trial.
Exceptions: Either party may bring a claim in small claims court (provided the claim meets the court’s jurisdictional limits and is brought on an individual basis, not as a class action). Additionally, either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.
13.3 Class Action Waiver
YOU AND HELVOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND HELVOR AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
13.4 30-Day Opt-Out Right
You have the right to opt out of this arbitration agreement by sending a written notice of your decision to opt out to hello@helvorshop.com within 30 days of first accepting these Terms or creating an account. The notice must include your full name, mailing address, email address associated with your account (if any), and a clear statement that you opt out of the arbitration provision. If you opt out, you will still be bound by all other provisions of these Terms, and disputes will be resolved in court in Sheridan, Wyoming.
14. Force Majeure
HELVOR LLC shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, pandemics, epidemics, government orders, labor strikes, supply chain disruptions, internet outages, or failures of third-party carriers or payment processors. In the event of a force majeure, our performance obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume performance as soon as practicable.
15. Severability
If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable while preserving the parties’ intent.
16. Entire Agreement
These Terms, together with our Privacy Policy, Refund and Return Policy, Shipping Policy, Payment Methods page, and any other legal notices published by HELVOR on the website, constitute the entire agreement between you and HELVOR LLC regarding your use of the Service and your purchase of products. They supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and HELVOR with respect to the Service.
